Terms of service
Welcome to MyPromise. These terms ("Terms") form a binding agreement between you and MyPromise, Inc. ("MyPromise," "we") and govern your access to and use of our website, mobile experience, and member services (collectively, the "Services"). By using the Services, you agree to these Terms.
1. Eligibility
You must be at least 18 years of age and a U.S. resident to use the Services. By creating an account, you represent that you meet these requirements and that the information you provide is accurate and complete.
2. The Services are not a medical practice
MyPromise is a technology platform. We do not practice medicine. Clinical judgment, diagnosis, and prescribing decisions are made independently by U.S. licensed clinicians who use the platform to deliver care to you. Compounded medications are dispensed by independent, accredited 503A and 503B compounding pharmacies under those clinicians' orders.
3. No emergency services
The Services are not intended for medical emergencies. If you are experiencing an emergency, call 911 or visit the nearest emergency department.
4. Membership and billing
Membership fees are billed on the cadence disclosed at checkout. You authorize us to charge your payment method automatically until you cancel. You can cancel any time from your member dashboard; cancellation takes effect at the end of the then-current billing period unless we say otherwise in writing.
5. Treatments and shipping
Treatment availability depends on clinician approval, state law, and current pharmacy capacity. Shipments are made in temperature-controlled packaging. Title and risk of loss for medications transfers to you upon delivery to your address. If a shipment is damaged or delayed, contact member care within 48 hours of receipt.
6. Acceptable use
You agree not to misuse the Services, including by sharing your account, attempting to access another member's information, scraping or reverse engineering the Services, or using the Services to violate any law or regulation.
7. Intellectual property
The MyPromise name, logo, and all content, software, and design elements of the Services are owned by MyPromise or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services solely for personal, non-commercial purposes.
8. Disclaimers
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any specific health outcome.
9. Limitation of liability
To the fullest extent permitted by law, neither MyPromise nor its officers, directors, employees, or agents will be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services. Our aggregate liability for any claim related to the Services will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim.
10. Dispute resolution
Most issues can be resolved by contacting us directly. If a dispute cannot be resolved informally, the parties agree to resolve it through binding arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules, except that you may bring qualifying claims in small-claims court. You and MyPromise each waive the right to a jury trial and to participate in a class action.
11. Changes to the Services or these Terms
We may update the Services and these Terms from time to time. Material changes to the Terms will be communicated via email or in-product notice. Your continued use of the Services after the effective date of the updated Terms constitutes your acceptance.
